Obtaining consent for medical treatment in older adults raises a number of complex challenges. Despite being required by ethics and the law, consent for medical treatment is not always validly sought in this population. The dynamic nature of capacity, particularly in individuals who have dementia or other cognitive impairments, adds complexity to obtaining consent. Further challenges arise in ensuring that older people comprehend the medical treatment information provided and that consent is not vitiated by coercion or undue influence. Existing mechanisms (...) to address issues surrounding consent for older adults only address incapacity and raise further challenges. As the ageing population increases, these issues are likely to become more profound, thus action is required to address these challenges. Raising awareness, more education, engaging with people with dementia, and conducting further research would assist in beginning to overcome these challenges. (shrink)

In a recent study, female dispersal in nineteenth-century Sweden has been found to correlate negatively with access to resources: women with limited access to local resources tended to migrate more frequently. In this paper I review the literature to explore whether this observed correlation was derived from a relationship in which a woman’s limited access to resources worsened her position in the marriage market and led to migration, as a strategy to improve resources and this position. Many studies within a (...) variety of disciplines indicate that a woman’s propensity to disperse from her parish of birth variedinversely with her propensity to inherit resources. My review of the literature suggests that the less likely a woman was to inherit resources, the lower her probability of marriage, the later her expected age at marriage, and the earlier she left home, presumably to improve her resource base for marriage. Hospitals long ago shed their role as alms houses for the poor. What vestiges remain of the early American hospital are the tax-exempt, nonprofit hospital form and a general perception that hospitals, as charitable institutions, owe a duty to their communities. The appropriateness of the nonprofit hospital tax exemption has long been debated, and many theories have been advanced to justify the tax exemption of nonprofit hospitals. In a growing number of jurisdictions, however, state and local authorities have gone beyond (...) the theoretical debate and are challenging the tax exemption of their nonprofit hospitals. For various reasons, efforts are afoot to capture greater community benefit from nonprofit hospitals.At the heart of such challenges is the debate over the nature and extent of the duty charitable institutions owe to their communities. A demand is growing for nonprofit hospitals to earn their tax exemptions by benefiting their communities in concrete ways. Some have been stripped of their tax-exempt status by local authorities or pressured to make payments in lieu of taxes. A number of states have recently implemented initiatives in an attempt to make hospitals more accountable for their community benefits. Many hospitals are responding to this heightened scrutiny in a proactive way, by voluntarily documenting community benefits. A number of nonprofit hospitals and hospital associations are cooperating with—or even sponsoring—state legislation in this area. (shrink)

Preterm birth is defined as delivery occurring before 37 weeks gestation.1 Infants born prematurely have increased risks of morbidity and mortality throughout life, especially during the first year. These risks increase as the gestational age at birth decreases.2 Additionally, there are significant racial and ethnic differences in preterm birth rates. In 2022, the rate of preterm birth among non-Hispanic black women was approximately 50% higher than that observed in non-Hispanic white women.1 The outcomes for these infants are also disparate–preterm birth (...) and low birth weight are the second-leading causes of infant mortality (deaths before 1 year of age). Notably, among preterm neonates, infants born to non-Hispanic black women have a mortality rate more than double that of infants born to non-Hispanic white mothers.3 Importantly, there is a small but significant group of neonates that can be classified as severely premature (those born <28 weeks). Infants born before 28 weeks have varied and uncertain outcomes. While this group accounts for only 0.4% of preterm births, it also accounts for 40% of deaths among preterm neonates.4 As noted by Romanis and Adkins, the advent of artificial amnion and placenta technology (AAPT) holds promise for its potential to address the physiologic complications and mortality risks of extreme prematurity by introducing amniotic substitutes that mimic in vivo placental oxygenation and substrate delivery. Language is more than a source of information for accessing higher-order conceptual knowledge. Indeed, language may determine how people perceive and interpret visual stimuli. Visual processing in linguistic contexts, for instance, mirrors language processing and happens incrementally, rather than through variously-oriented fixations over a particular scene. The consequences of this atypical visual processing are yet to be determined. Here, we investigated the integration of visual and linguistic input during a reasoning task. Participants listened to sentences containing conjunctions or disjunctions and (...) looked at visual scenes containing two pictures that either matched or mismatched the nouns. Degree of match between nouns and pictures and between their expected and actual spatial positions affected fixations as well as judgments. We conclude that language induces incremental processing of visual scenes, which in turn becomes susceptible to reasoning errors during the language-meaning verification process. (shrink)

Face aux catastrophes annoncées, aux risques d'effondrements et aux désarrois qu'ils suscitent, est apparu en France depuis 2015 une « bataille des récits » où s'entremêlent études scientifiques, travaux de vulgarisation, mais également communautés et collectifs affinitaires. Les « grands récits » des XIXe et XXe siècles ayant fait faillite, il est courant d'entendre aujourd'hui que de nouveaux récits collectifs doivent émerger. Ils répondraient aux inquiétudes et redonneraient de l'espoir, leur conférant alors un potentiel quasi magique. Ce livre décode les fonctions et les puissances politiques du récit et ses enjeux, décrypte et compare les récits d'effondrements afin d'en comprendre les origines, les vertus, les crispations et les affects qu'ils brassent. Au XIVe siecle, Gauthier Burley, philosophe et theologien a la faculte des arts comme a la faculte de theologie, a Paris et a Oxford, doit en partie sa celebrite pour son opposition a Ockham sur la distinction entre les categories de substance et de quantite. Si cette opposition est bien connue dans le domaine de la logique medievale, elle n'a pas fait l'objet d'une etude systematique en philosophie naturelle. Tel est l'objectif du present ouvrage: montrer que le debat sur la (...) quantite initie par Gauthier Burley donne a cette categorie une place centrale dans l'emergence de nouvelles trajectoires doctrinales scientifiques de l'entre-deux siecles, du contexte eucharistique et de la logique aristotelicienne vers la physique. Ce livre, qui se veut une synthese accessible, fait ainsi decouvrir la richesse d'une oeuvre tres dense et peu connue. (shrink)

L’histoire de la métaphysique à Genève pendant l’époque moderne est liée à la figure de David Derodon (c. 1600-1664), philosophe et théologien calviniste français. Il soutient que la métaphysique est la science de l’étant commun aux corps et aux esprits et que, pour cette raison, elle doit être distinguée de la pneumatique et de la somatique. Il s’agit, en d’autres termes, d’une métaphysique fortement « ontologisée » qui traite des choses neutres. Le but de cet article est de montrer la (...) diffusion de cette définition de la France à la Suisse jusqu’à son emploi par le cartésien Jean-Robert Chouet (1642-1731), professeur à la célèbre Académie de Genève fondée par Calvin en 1559. Chouet va encore plus loin en donnant une dénomination nouvelle à cette version de la métaphysique, qui est celle d’ontologie (ou ontosophia ), et en y introduisant le cogito cartésien. (shrink)

Une enquête de terrain offrira des clés de compréhension de ce phénomène, au regard des remaniements de l’identité sexuée propres à cette période. Le pubertaire confronte l’adolescent à un bombardement pulsionnel et à un déficit de représentations qui viennent profondément bouleverser son rapport à l’autre sexué, générant tension entre les genres et parfois de la violence. A recent study by P.R. Blum suggests the hypothesis of an ideal line from Scotus to Mastri, passing through Perera, which would tend towards a new concept of metaphysics attainable through the use of abstraction by indifference. This essay intends to test this hypothesis starting from the way in which Perera questions the unity of metaphysical abstraction through a series of innovative interpretations that are widely received in both Catholic and Reformed and Protestant domains. A first interpretation, less radical, advances (...) a model of metaphysical abstraction, taken up by Mastri and Micraelius, which maintains the unity of metaphysics; a second interpretation, more radical, breaks the methodological unity of metaphysics through a clear distinction between ‘real’ abstraction from matter (secundum rem et rationem) and ‘mental’ abstraction by indifference (secundum rationem tantum) and, consequently, between metaphysics and ontology. For decades, the discussion on children’s competence to consent to medical issues has concentrated around normative concerns, with little progress in clinical practices. Decision-making competence is an important condition in the informed consent model. In pediatrics, clinicians need to strike a proper balance in order to both protect children’s interests when they are not fully able to do so themselves and to respect their autonomy when they are. Children’s competence to consent, however, is currently not assessed in a standardized way. (...) Moreover, the correlation between competence to give informed consent and age in children has never been systematically investigated, nor do we know which factors exactly contribute to children’s competence. The relationship between Ars and Natura undergoes a manifest evolution from Aristotle to the medieval period and the time of Walter Burley. While Aristotle views all the possible complementarities between natural things and artificial things with regard to their perfection, the medieval commentators from Doctor planus and perspicuus on define artificialia in natural philosophy increasingly as perfect figures in actuality, divisible and with infinitely arrangeable parts. In Burley's works in particular, the products of art are likened to geometrical figures within (...) the structure of the continuous, such as lines, points and surfaces, and used as arguments against Ockham in their dispute over the ontology of indivisibles. This article aims to disrupt received views about the significance of J. L. Austin's contribution to philosophy of language. Its focus is Austin's 1955 lectures How To Do Things With Words . Commentators on the lectures in both philosophical and literary-theoretical circles, despite conspicuous differences, tend to agree in attributing to Austin an assumption about the relation between literal meaning and truth, which is in fact his central critical target. The goal of the article is to correct this misunderstanding and (...) to show that Austin is deeply critical of a picture of correspondence between language and the world which nearly half a century after he delivered his lectures continues to structure philosophical discussions of language. Walter Burley, as his contemporaries, commented on the problematic coexistence of the divisibility and the indivisibility in the structure of the continuous. Much more, battling against his opponent Wilhelm of Ockham about the ontology of the category of quantity, he admits an original structure of continuous who seems to contain at the same time intervals or divisible (...) parts and indivisible points. Alice Crary is a moral and social philosopher who has written widely on issues in metaethics, moral psychology and normative ethics, philosophy and feminism, critical animal studies, critical disability studies, critical philosophy of race, philosophy and literature, and Critical Theory. She has written on philosophers such as John L. Austin, Stanley Cavell, Cora Diamond, John McDowell, Iris Murdoch and Ludwig Wittgenstein. Selon Derrida, 'Tout vrai questionnement est sommé par un certain type d'eschatologie' : la philosophie serait tirée de son sommeil dogmatique par une injonction eschatologique. Ainsi, alors que la notion d'eschatologie est originellement théologique et désigne la doctrine de la fin des temps, elle est convoquée par la philosophie contemporaine chez Heidegger, puis chez Levinas et Derrida, justement pour réfuter toute philosophie téléologique de l'histoire. Comment comprendre ce réinvestissement inattendu? Cet ouvrage propose d'abord une généalogie du motif eschatologique dans la (...) philosophie contemporaine, afin de comprendre comment l'eschatologie peut s'émanciper du domaine théologique et acquérir une spécificité philosophique. Ensuite, il s'attelle à décrire le motif eschatologique propre à Levinas et Derrida, qu'ils pensent en dialogue avec le messianisme et la phénoménologie. Enfin, il s'intéresse à l'opérativité spéculative de ce motif, qu'on appelle 'eschatologie du présent' : un schème qui exige d'interrompre le présent et la présence, pour construire une éthique de l'événement. L'eschatologie doit ainsi être pensée comme l'insomnie de la philosophie, 'l'appel à une infinie responsabilité de l'homme, à un inlassable éveil', selon la formule de Levinas.
